Privacy Policy

Information concerning the processing of personal data, in accordance with article 13 of Legislative Decree no. 196/20003

In accordance with the obligations under D.Lgs. June 30, 2003, No. 196 concerning the processing of personal data (so called "code of Privacy"), come into force 1 January 2004, we hereby inform you that the company Vinilchimica S.r.l. based in Via Sonna 6, 24030 Caprino Bergamasco (BG) VAT registration number 02422230165 (below just "the Company") will process your personal data that have been or will be communicated to us by you or other parties. The processing of personal data will be conducted in compliance with the existing laws and the following conditions.

1. Purposes of data processing

The processing of personal data is directed exclusively to the following purposes:

  1. for demands prior the conclusion of the sale agreements, to enforce the latter and for the asset positions and those arising from them;
  2. to comply with any obligation imposed by laws or regulations, particularly in the field of taxation;
  3. for operational, managerial and accounting needs;
  4. for the recording of access to the website of the Company and the use of services connected to it
  5. to monitor needs related to the progress of commercial relationships with customers and/or of the risk associated and to improve these relationships
  6. for commercial, operational and strategical marketing purposes

2. Methods of data processing

The personal data processing may be consisting, other than their collection, in their registration, conservation, modification, communication, cancellation, diffusion, etc and it will be carried out both through papework and electronic and telematic instruments, with methods and tools to ensure maximum security and confidentiality, by persons authorized to do so in compliance with the requirements of Art. 31 and following of D. Lgs 196/03 related to "minimum safety measures for personal data processing". Particularly, all technical, electronic, organizational, logistical and procedural safety techniques as required by D. Lgs 196/03 and Annex B to it, in a way that guarantees the minimum level of protection of personal data provided for by the law.
Furthermore, the methodologies applied guarantee that the access to data is allowed exclusively to the people in our Company in charge of the data processing.

3. Data providing

Providing data is:

  1. Mandatory to reach the objectives connected to obligations prescribed by law and/or other binding rules
  2. Necessary for the correct establishment and prosecution of the relationship developed with you

Any denial to supply the above data, albeit rightful, might compromise the regular progress of the relationship with our Company and, particularly, might entail the impossibility for us to implement the required services and the connected billing.

4. Communication and data diffusion

The external communication of the personal data gathered for the purposes stated in part 1 might occur only when:

  1. Such communication is mandatory to ensure the meeting of the requirements prescribed by law or other binding rules;
  2. Such communication is mandatory to ensure the correct establishment or prosecution of the relationship developed with you

The personal data gathered for the above-mentioned purposes might be communicated,  with regard exclusively to their specific competencies, to public and private entities, physical or legal entities and with business purpose and/or of management of information systems and/or payment systems, included external entities that perform specific assignments on behalf of our Company. Particularly, the data might be communicated to the following categories of entities: sales network, banking institutions, societies specialized in the handling of payments, legal and consulting firms, entities in charge of the budget review of our Company, public authorities or administrations for legal requirements, Italian and foreign suppliers, finance and delivery companies, third parties charged of the quality control of the commercial and logistic flow.
Data might also be released but only in aggregate and anonymous form and for statistical purposes.

5. Data transferring abroad

Within the strictly required limits necessaries to the execution of the contractual relationship with you, your personal data might be communicated to third parties (such as suppliers) situated abroad, inside or outside the European Union.

6. Data Subject's rights

According to article 7 and following of D. Lgs. 196/2003, you have also the right of:

  1. Obtain confirmation as to whether or not personal data concerning you exist and communication of such data in intelligible form;

  2. Obtain, by the data controller or the data processing person in charge:

    i) information on the source of the personal data, on the purposes and methods of the processing, on the logic applied to the processing if carried out with the help of electronic means;
    ii) identification of data concerning data controller, data processors and the representative designated by a foreign entity for data processing in Italy;
    iii) identification on entities or categories to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representatives in the State's territory, data processors or persons in charge of the processing.
  3. Obtain:
    i) update, rectification or integration of the data;
    ii) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
    iii) certification to the effect that the operations to the part (I) and (II) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
  4. To object, in whole or in part:
    i) on legitimate grounds to the processing of personal data concerning you, even though they are relevant to the purpose of the collection;
    ii) to the processing of personal data concerning you where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.

The above mentioned rights may be exercised either directly or through the intermediary of persons whom you appoint for this purpose, in the form provided for in art. 8 and 9 of D. Lgs. 196/2003.

7. Data processing handler and person in charge

We also confirm you that handler of the processing is the Company, embodied by its provisional legal representative, situated in Via Sonna 6, 24030, Caprino Bergamasco (BG).
The person in charge of the processing of your data, in this case domiciled at the Company headquarter, is Mrs. Daniela Martinelli.

8. Consent for the processing

We would like to inform you at last that the granting of your consent, with the methods and for the purposes above mentioned, is optional. In case of your refusal to grant consent, our Company can't process your personal data but only use them for obligations prescribed by law or other existing binding rules, with the possible consequences above described in section 3.
